Social Security provides
payments not only to retired individuals but to younger people who, as a result
of injury or medical conditions, can no longer support themselves for at least
one year. The federal Social Security Administration runs two separate
disability programs. SSI and Social Security Disability. Both programs offer
ongoing monthly cash assistance and are exceptionally similar in nature. Social
Security benefits are greater than those available under SSI.
To qualify for benefits a person must submit an Application at their local Social Security office. If a person's initial Application is denied they may appeal the decision and ask for "Reconsideration". If they are denied on Reconsideration they may, within 60 days of the decision, appeal their case further and receive a hearing before an Administrative Law Judge. Administrative hearings can be further appealed to the US District Court. While initial Applications for benefits can be filed without the need for a lawyer getting a lawyer involved after a denial is always a good idea. Social Security maintains a web site where a great deal of current and useful information can be accessed. Our office will handle Social Security disability claims on a contingency fee basis, that is, we charge no fee unless we are successful in helping you receive benefits.
